Terms of use of the Muscle Atlas Database

1. Scope and enforceability

1. The purpose of this document is to define the conditions of access and use of the Muscle Atlas Database, accessible at the address muscleatlas.institut-myologie.org (hereinafter referred to as the "Database"), of which the Association Institut de Myologie (hereinafter referred to as "AIM") is the publisher.

2. The requirements contained in this document apply to all use of the Database.

3. The present general conditions are opposable, deemed to have been read and applicable, on the date of the first use of the Database by the user and by the sole fact of his navigation on it. The fact that the user does not have to click to accept these terms and conditions does not constitute an obstacle to their enforceability.

4. The user may at any time discontinue the use of the Database but remains liable for any prior use.

2. Access

5. Access to the Database is free.

6. The AIM undertakes to make its best efforts to ensure that the Database is accessible to the user at all times. However, the AIM shall not be held liable in the event of the Database being unavailable for any reason whatsoever.

7. The AIM reserves the right to interrupt access to the Database at any time, in particular for maintenance reasons. In this case, the AIM shall not be bound by any obligation of notice to users of the Database.

8. In addition, certain parts of the Database are only accessible to users with a personal account and password.

9. Access to the Database by users who do not have a personal account is strictly limited to the free area of the Database.

10. The user of the Database acknowledges that he/she has the necessary skills and means to access and use this Database.

11. The user of the Database acknowledges that he/she has verified that his/her computer configuration allows him/her to use the Database and its functionalities.

12. The AIM makes every effort to provide users with adequate information and tools but cannot be held responsible for discontinuities in the Database and its services, whether voluntary or involuntary.

3. Responsibility

13. The AIM offers information or tools that are available and verified but cannot be held responsible for errors, lack of availability of features or the presence of viruses on its site.

14. The AIM cannot guarantee the accuracy, exhaustiveness, completeness and updating of the information published on its Database, nor the permanence of its proper functioning or its total computer security.

15. The information provided on the Database is for information purposes only and does not exempt the user of the Database from additional and personalized analysis.

16. The user of the Database undertakes to use the services of the site as well as all the information to which he/she may have access only for purposes that are in accordance with public order, good morals and the rights of third parties.

17. The user of the Database acknowledges that he/she uses the information and tools available on the Database under his/her sole responsibility.

18. Users of the Database who do not have a personal account are prohibited from accessing personal accounts and undertake not to enter or attempt to enter such accounts. Such access will be considered fraudulent access.

19. If the user of the Database who does not have a personal account inadvertently enters such an account, he/she undertakes to inform the publisher of the Database at the following using the comment section.

4. Safety

20. The user of the Database undertakes not to commit any act that could jeopardize the computer security of the Database or the computer systems of other users.

21. The user of the Database undertakes not to interfere with or interrupt the normal operation of the site.

5. Intellectual Property

22. The content of the Database, the general structure as well as the software, texts, animated or non-animated images, photographs, know-how and all other elements composing the Database are the exclusive property of the AIM or its partners who have granted it a license.

23. The same applies to any databases appearing on the Database which are the exclusive property of the AIM and are protected by intellectual property rights.

24. The distinctive signs of the AIM and its partners, such as domain names, trademarks, names and logos appearing on the Database are protected by intellectual property rights.

25. Any total or partial reproduction of these distinctive signs made from the elements of the Database without the express authorization of the AIM is therefore prohibited.

6. Hyperlinks texts

26. Users of the Database may not set up a link to the Database without the express prior authorization of the AIM.

27. In no case shall this authorization be considered an implicit affiliation agreement.

28. In any event, links to the Database must be removed at the AIM's first request.

29. The AIM reserves the right to set up links on the Database giving access to web pages other than those on its Database.

30. The AIM cannot be held responsible for access by users of the Database via links set up within the framework of the Database to other resources present on the Internet network, nor for the content of the information provided on these sites under the activation of the link.

7. Modification

31. The AIM reserves the right to modify and update these general terms and conditions of use at any time and without notice. The user of the Database is expressly informed that the version of the general terms and conditions of use that is valid is the one that is accessible online at the time he/she connects to the Database.

32. The user of the Database is therefore invited to consult them regularly.
